Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Blink mobile application, website, and related services (collectively, the "Service") operated by Night House LLC ("Night House," "we," "our," or "us"). Please read these Terms carefully before using the Service. By creating an account or using Blink you agree to be bound by these Terms.
1. Eligibility and Age Requirements
You must be at least 18 years old to use Blink. By creating an account you represent and warrant that you are 18 or older. If we discover that an account belongs to someone under 18, we will terminate that account immediately. Blink is intended for use in the United States. Access from other jurisdictions is at your own risk and subject to local laws.
2. Account Registration
You must provide a valid phone number to register. You are responsible for maintaining the security of your phone and OTP codes and for all activity that occurs under your account. You agree to notify us immediately at hello@blinksocial.app if you suspect unauthorized access to your account. Night House is not liable for any loss or damage resulting from your failure to protect your account credentials.
3. Acceptable Use Policy
You agree to use the Service only for lawful purposes and in a manner consistent with these Terms and all applicable laws. You agree not to:
- Post, transmit, or solicit content that is illegal, abusive, threatening, harassing, defamatory, obscene, or otherwise objectionable.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Stalk, harass, intimidate, or harm another user, or facilitate such behavior.
- Use the Service for commercial solicitation, spam, or unsolicited promotional messages.
- Collect or harvest other users' personal information without their consent.
- Interfere with or disrupt the Service or its servers, or attempt to gain unauthorized access to any part of the Service.
- Reverse engineer, decompile, or attempt to extract the source code of any part of the Service.
- Create fake accounts, manipulate location data, or otherwise misrepresent your identity or location.
- Use the Service in connection with any unlawful purpose, including solicitation, trafficking, or exploitation of any person.
Violation of this Acceptable Use Policy may result in immediate account suspension or termination without notice.
4. User-Generated Content
You retain ownership of content you submit to Blink (profile photos, display name, bio, messages, and activity tags). By submitting content you grant Night House a non-exclusive, royalty-free, worldwide license to store, display, and distribute that content solely as necessary to operate the Service.
You are solely responsible for content you post. Night House does not endorse user-generated content and is not liable for any content submitted by users. We reserve the right (but not the obligation) to remove content that violates these Terms or our Community Guidelines.
You represent and warrant that: (a) you own or have the necessary rights to any content you post; (b) your content does not infringe the intellectual property, privacy, or other rights of any third party; and (c) your content complies with these Terms and all applicable laws.
5. Location and Live Sessions
Blink's core feature allows you to broadcast your coarse proximity zone to other users for a limited time window. By going live, you voluntarily make your zone-level location and profile visible to other active users in your area. You may end your live session at any time. Night House is not responsible for interactions that occur as a result of your decision to go live.
6. Account Termination
By you: You may delete your account at any time from Profile → Settings → Delete Account. Deletion is permanent and removes your profile, messages, and associated data within 30 days.
By Night House: We may suspend or permanently terminate your account, without notice or liability, if we determine in our sole discretion that you have violated these Terms, engaged in fraudulent or harmful conduct, or for any other reason that we believe threatens the safety or integrity of the Service or its users. Termination of your account does not entitle you to any refund or compensation.
7. Intellectual Property
The Blink name, logo, app design, and all content created by Night House are the exclusive property of Night House LLC and are protected by copyright, trademark, and other applicable laws. You may not use our trademarks or branding without our prior written consent.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. NIGHT HOUSE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Blink is a platform for connecting people in public places. Night House does not screen users beyond phone number verification and is not responsible for the conduct of any user online or offline. Meeting strangers always carries inherent risks; please review our Safety Guidelines before using proximity features.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NIGHT HOUSE LLC AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF NIGHT HOUSE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO NIGHT HOUSE IN THE TWELVE MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless Night House LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the Service.
11. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict-of-law provisions. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Fulton County, Georgia, and you consent to the personal jurisdiction of those courts.
Before initiating any formal legal proceeding, you agree to first contact us at hello@blinksocial.app to attempt to resolve the dispute informally.
13. Changes to These Terms
We may revise these Terms at any time. We will provide notice of material changes by updating the effective date and, where appropriate, by in-app notification. Your continued use of the Service after the revised Terms take effect constitutes your acceptance of the changes.
